AbstractThe article analyzes the historical process of the legal statements of the right of peoples originating on earth, the constant invasions of them by grileiros, prospectors, among others, causing expropriation and deaths of those who resist and fight for the guarantee and enjoyment of natural goods. According to bibliographic research, we can reaffirm the need for land demarcation, respect for indigenous peoples, the preservation of life and its customs, as provided for in the Federal Constitution of 1988.
